Juridical Protection of Fundamental Rights after Lisbon

Abstract

The coming into force of the Treaty of Lisbon generated many controversies with regard the field of protection of human rights. The ground for discord is represented by Article 6, paragraph 2 from TEU that provides for the formal accession of European Union to the European Convention of Human Rights, accession that will integrate EU in the Strasbourg control system, including here the jurisdiction of the European Court of Human Rights. Despite the political enthusiasm in this area, the juridical technicalities of this accession are extremely complex and lead to several major queries, many of them referred to into the following article
